RESIDENTIAL TENANCY ACT

Tenant-caused undue damage and ordinary wear are not the same

The Act makes a tenant responsible for undue damage caused by the tenant's actions or neglect, or by a person the tenant permits on the property. It separately says a tenant is not responsible for reasonable wear and tear.

SECURITY DEPOSIT

A deposit is not an insurance policy

PEI caps a security deposit at one week's rent for weekly tenancies and one month's rent otherwise. It is held under statutory rules and does not provide contents, liability or Additional Living Expenses coverage.
