ONTARIO AUTO REFORM · JULY 2026

Ontario Accident Benefits After July 1, 2026

Ontario changed the default structure of statutory accident benefits on July 1, 2026. Medical, rehabilitation and attendant care remain mandatory, while other accident benefits became optional for policies under the new framework.

Policy dates matter. Existing policies renewing after July 1, 2026 can have transition rules, so your certificate and renewal documents should be checked rather than assuming every policy changed in exactly the same way overnight.

Most accident benefits became optional

FSRA says that as of July 1, 2026 only medical, rehabilitation and attendant care benefits remain mandatory. Other accident benefits — including income replacement, non-earner, caregiver, death, funeral and several expense-related benefits — are optional for policies under the new framework.

Which benefits remain mandatory?

Medical, rehabilitation and attendant care benefits remain part of the mandatory accident-benefit protection for policies entered into on or after July 1, 2026. FSRA says the standard non-catastrophic medical, rehabilitation and attendant-care amount is C$65,000, with options to purchase higher limits.

For catastrophic impairment, FSRA lists a C$1,000,000 standard medical, rehabilitation and attendant-care amount, with an option to increase that protection.

Which accident benefits are optional?

FSRA lists income replacement, non-earner, caregiver, lost educational expenses, expenses of visitors, damage to personal items, death, funeral, dependant care, housekeeping and home maintenance, and indexation among benefits that can be optional under the post-July-2026 framework.

The options and limits available can vary, so an insured should review the certificate and insurer documentation rather than assume a benefit is included because it existed in an older standard package.

What happens to a policy that existed before July 1, 2026?

FSRA's 2026 settlement-disclosure material states that for certain policies issued before July 1, 2026 and renewed on or after that date, existing optional-benefit protection can be deemed to continue unless the insured and insurer agree in writing to decline or change those benefits.

This transition detail is why Canada Rate Lab labels the reform by policy date and avoids a blanket statement that every Ontario driver automatically lost the same benefits on July 1.

Do accident benefits depend on who caused the crash?

FSRA says statutory accident benefits are available regardless of who caused the accident, subject to eligibility, exclusions, the policy and the benefits actually purchased.

The question of accident benefits is therefore different from the question of fault for vehicle damage or how an at-fault accident may affect future premium rating.
